Terms of use
These terms govern the use of the Kivoform app and the forms published with it. By using the service, you accept them.
1. The service
Kivoform lets you create forms on an iPhone, share them by link or QR code, and view the responses. People who respond need neither the app nor an account. The publisher is described in the legal notice.
The app is provided under Apple’s standard licence for App Store apps. These terms set out the rules specific to the Kivoform service.
2. Your account
An anonymous account is created the first time you open the app, with no sign-up. Signing in with Apple is optional and lets you get your forms back after a reinstall or on another iPhone. If many anonymous accounts have been created from the same iPhone, signing in with Apple may be required to publish on the free plan. You’re responsible for how your account is used. You can delete it at any time from the Account screen, which permanently erases your forms and their responses.
3. Plans and subscriptions
Kivoform offers a free plan and paid subscriptions (Basic, Premium, and Pro), monthly or yearly, that raise limits and unlock features. Details and current prices are shown in the app before any purchase.
- Payment is handled by Apple and charged to your Apple account when you confirm the purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- You manage or cancel your subscription in Settings, then your name, then Subscriptions. Cancellation takes effect at the end of the period you’ve already paid for.
- Refunds are handled by Apple, at reportaproblem.apple.com.
- Purchases made in the App Store are also subject to Apple’s terms, including any right of withdrawal granted to consumers.
- Deleting your account doesn’t cancel the subscription, which you need to stop with Apple.
When your monthly response limit is reached, your forms stop accepting responses until the first day of the next month, or until you change plans. If a subscription ends, your forms and responses are kept, and the features and limits of the free plan apply again.
4. Rules for using forms
A published form can be accessed by anyone who has its link. You’re responsible for its content and for how you use the responses. You may not use Kivoform for any of the following.
- Sharing content that is illegal, hateful, or violent, or that infringes the rights of others.
- Deceiving the people who respond, for example by impersonating another person or an organisation, or by trying to get usernames, passwords, or payment card numbers.
- Collecting sensitive data, such as health information, without following the regulations that apply to it.
- Sending spam, or getting around the service’s limits and protections.
If you collect personal data with a form, you’re the data controller for it. You must tell the people who respond how you’ll use it and respect their rights. Kivoform then acts as your technical processor.
5. Reporting content
Every public form has a Report this form link. You can also write to contact@kivoform.com with the form’s address. A form that clearly goes against these terms is reviewed quickly, then closed or deleted if necessary. The account involved may be suspended in case of repeated abuse.
6. Availability and changes to the service
Kivoform works to keep the service available at all times, but can’t guarantee that there will be no interruptions or errors. Features, limits, and prices may change. An unfavorable change doesn’t apply to a subscription period you’ve already paid for.
7. Ownership and content
Kivoform and its visual identity remain the property of its publisher. You keep all rights to your forms, images, and responses. You grant Kivoform the right to host and display them to provide the service, and for that purpose only.
8. Liability
Kivoform is a collection tool. It’s up to you to check that it suits your situation, and to back up your important responses with the CSV or Excel export. To the extent permitted by law, the publisher’s liability is limited to direct damages and can’t exceed the amounts you paid for your subscription over the last twelve months. These limits don’t apply where the law forbids it, in particular with regard to consumer rights, and consumers keep the benefit of their legal guarantees.
9. Personal data
How your data is handled is described in the privacy policy.
10. Governing law and disputes
These terms are governed by French law. If a problem comes up, we recommend trying to resolve it informally first. Write to us at contact@kivoform.com, as most situations are settled that way. If you’re a consumer, you can use a consumer mediator free of charge. The rights granted to you by law remain yours, including the right to bring your case before the competent courts.
11. Changes to these terms
These terms may change. The update date appears at the top of this page. Continuing to use Kivoform after a change means you accept the new version.
